Terms and conditions for special transport services
Legal basis for providing special transport services
Special service orders are performed pursuant to Government Decree 213/2012 (30 July) on the detailed conditions of bus passenger transport services not regulated by Regulation (EU) No 181/2011, exemptions from the conditions of the Regulation, the conditions of bus transport services and the rules on the road passenger transport business regulations, and Government Decree 261/2011 (7 December) on road transit for remuneration, own-account transport of goods, and passenger transport for remuneration by bus and own-account transport of passengers, and on the amendment of the related legislation.
Fare calculation for special services
Transportation as a special service is priced freely, without any restrictions. VOLÁNBUSZ Zrt. treats each request individually and will provide our Customers with a tailored offer, taking into account the route, the number of participants, the type of bus requested and individual requests. In addition to the fare, the customer will be charged for any other fees and costs incurred in order to perform the special service. Such costs include, but are not limited to:
- VAT, motorway tolls, road tolls, parking charges, guarding charges, ferry charges, overnight accommodation charges, drive in fees,
- the daily allowance and accommodation costs of the bus driver(s). In the case of a multi-day special service (both domestic and international), the customer must provide, book and pay the costs of 1-2 bed accommodation suitable for the driver(s).
If those charges were paid by the carrier at the time they were incurred, they will subsequently be passed on to the customer. The currency necessary for the driver(s)' stay abroad (daily allowance, accommodation fee) and for the operation of the bus abroad (parking and guarding fees, toll, ferry fees, etc.) is provided by the carrier against payment in HUF and invoiced to the customer (at the daily exchange rate) together with the carriage charge.
Ordering a special service
Orders for special services are accepted only in writing and will be confirmed in writing. When placing an order, the name and address of the customer, the number of passengers, the route and, if possible, the expected kilometres per day, must be provided in detail. The customer must draw up a passenger list before the start of the service, indicating the names of the passengers who will be using the special service. The customer must provide the passenger list to the carrier or bus driver at the time of ordering, but no later than the start of the journey.
The processing of passenger list data is provided for in Section 22 (8) of Government Decree 261/2011 (7 December). The information on the data processing for passenger transport as a special service is available in the privacy notice on the website of VOLÁNBUSZ Zrt., at https://www.volanbusz.hu/hu/volanbusz/adatvedelmi-tajekoztato. It is the responsibility of the Customer to inform the parties concerned about the privacy notice, which the Customer acknowledges by signing the order.
Payment terms, options
VOLÁNBUSZ Zrt. will invoice an advance charge on the expected fare for the special service (at the rate of 80% for domestic customers and 100% for foreign customers). Failure to pay the advance charge by the due date may result in the cancellation of the special service. In that case, VOLÁNBUSZ Zrt shall not be liable for compensation for the cancellation of the special service. The advance charge paid will be refunded in the event of cancellation of the special service, subject to the conditions for cancellation. After performance, a final invoice is issued, in which the remaining advance charge and/or excess performance is invoiced. Invoicing is based on the certificate of completion issued in accordance with the details of the journey log. Payment options for special services:
By bank transfer: an electronic (cashless) payment method whereby the Customer instructs their bank to transfer a specified amount. The transfer will be made to the payment account sent by the special service administrator, and VOLÁNBUSZ Zrt. must be indicated as the beneficiary.
In cash: at the official premises of VOLÁNBUSZ Zrt. at a time agreed with the special service administrator.
By postal cheque: the billing method can be specified in advance, and the amount on the cheque is paid through the Post Office.
Cancellation of the special service
A booked and confirmed special service may only be cancelled in writing. If the cancellation is made within 48 hours prior to departure for domestic journeys and within 5 days for international journeys, the Customer is liable to pay the following:
- 20% of the expected fare indicated in the special service offer.
- Expenses already incurred and justified in connection with the operation of the bus abroad and the arrangements for the bus driver(s) to work abroad (visas, additional certificates, etc.).
- If the cancellation is made after the bus has departed for the pick-up, the cost of the mileage incurred in connection with the pick-up, without discount.
Deviation from the programme at the customer's request
During a special service, the agent of the customer may request a change to the route, which must be entered by the driver in the ‘Comments’ section of the journey log. The bus driver must refuse to execute any instruction which is contrary to employment law, the Highway Code or other applicable legislation or internal instructions, or which endangers the safety of persons or property (e.g., route unsuitable for bus transport).
Acknowledging the completion of a special bus service
Upon completion of the journey, the customer or their agent must certify the completion of the special service and the correctness of the performance data in the journey log, by signing it. Please carefully check the route, mileage and times in the journey log, as those will be used for invoicing the special service. In the event of arrival later than expected, any additional costs incurred shall be borne by the customer.
Employment of a bus driver
The Customer acknowledges the legal requirements concerning the working time and rest periods of bus drivers. The special service must be organised in a manner that ensures that the driving time of the individual driver(s) does not exceed 9 hours per day, that they are provided at least 11 hours of uninterrupted rest in each 24-hour period, and Regulation (EC) No 561/2006 is complied with. After 4.5 hours of driving, the driver must take a break of at least 45 minutes, which may be replaced by a break of at least 15 minutes spread over the driving time, followed by a break of at least 30 minutes. The bus driver(s) may not be obliged to work overtime.
Insurance
Passengers using the special service are covered by insurance included in the special service fee if the insurance event occurs on our bus (https://www.volanbusz.hu/hu/volanbusz/szolgaltatasaink/buszberles/biztositas-a-berelt-autobuszokon).
The insured event must be reported to the bus driver, or to the manager of the passenger area during the journey, if it occurs in the passenger area. In the case of travel on international special service, where verbal communication is not feasible, the passenger must notify VOLÁNBUSZ Zrt of the insured event in writing, without delay.
For other cases (e.g., sightseeing, accommodation, leisure activities), it is recommended to acquire the appropriate travel insurance, which is also available at VOLÁNTOURIST Travel Offices (https://www.volantourist.hu/hu/utazasi-irodak).
Privacy
The data you provide to VOLÁNBUSZ Zrt. will be processed in accordance with the new European General Data Protection Regulation (GDPR) and corporate regulations prepared on the basis thereof.
